1.General Provisions
1.1.This public offer (hereafter referred to as the “Offer”) is an official offer of Individual Entrepreneur (IP) A.V. Palagin to any individual person to enter into a retail product purchase and sale agreement with Individual Entrepreneur A.V. Palagin remotely on the terms and condition provided herein. This contains all essential conditions of the Offer.
1.2.An order placed by the Customer on the Website means that the Customer agrees with all the terms and conditions of this Offer, the Confidentiality Policy and the Website User Agreement.
1.3.The Website is entitled to change the Offer without prior notification of the Customer.
1.4.The Offer will remain effective for an unlimited period of time unless otherwise specified on the Website.
1.5.In section “Main” the Website provides the Customer with complete and accurate information about products/services, including basic information about usability of products, the place of their origin, warranty period and useful life of products.
2.1.The Website undertakes to deliver products intended for personal, family, home or any other use not related to entrepreneurial activity to the Customer on the basis of a respective order placed on the Website, and the Customer undertakes to accept and pay for the Products as provided in this Offer.
2.2.The names, prices and quantity of products, and any and all other terms and conditions of the Offer are determined on the basis of information provided by the Customer when placing an order.
2.3.The right of ownership to any products ordered shall be transferred to the Customer at the moment of actual delivery of the products to the Customer and upon payment for the products in full made by the latter. The risk of accidental loss or damage of the products shall be transferred to the Customer at the moment of actual delivery to the Customer.
2.1.All prices for product set by the Seller unilaterally and unconditionally are provided on respective pages of the online store at the address: www.dushagreya.ru.
2.2.All prices for products are denominated in Russian rubles and include the amount the value-added tax.
2.3.The final price for a product is determined taking into account all applicable discounts in the following order:
• Promotional discounts;
• Online promo codes; and
• Loyalty discount.
2.4.All settlements between the Website and the Customer are made as provided in section “Payment Options”.
4.The Moment of Entering into the Offer
4.1.This Offer (agreement) is deemed accepted as soon as the Customer places an order for products pursuant to the terms and conditions of this Offer. An order for products is made by the Customer as provided in section “How to Place an Order”.
4.2.By accepting this Offer, the Customer agrees with the following:
- All data (including personal data) provided by him/her in signup forms are provided voluntarily;
- All data (including personal data) provided by him/her in signup forms are transmitted via communication channels in the Internet;
- All data (including personal data) provided by him/her in signup forms are provided to the Website for the purposes specified in this Offer, the Confidentiality Policy and the Website User Agreement and can be provided to any third party for the purposes specified herein;
- All data (including personal data) provided by him/her in signup forms can be used by the Website in order to promote products and services by direct contact with the Customer via communication channels;
- All data (including personal data) provided by him/her in signup forms can be provided to the bank handling transactions on payment for orders places in order to additionally protect the data against fraudulent actions; and
- Customer’s consent to his/her data (including personal data) processing provided in signup forms shall remain in effect for an unlimited period of time and can be revoked by the Customer or his/her legal representative under an application submitted to the Website in writing.
5.Return of Products and Refund
5.1.Products shall be returned in accordance with the Law of the Russian Federation “On Protection of Consumers’ Rights”.
5.2.Any amounts paid for products shall be either credited to Customer’s credit card account or refunded by postal money transfer.
6.Delivery of Orders
6.1.Products shall be delivered to the Customer within the term agreed on by the Parties in the process of confirmation of a respective order by Website’s specialist.
6.2.If products are delivered by a courier service, the Customer shall sign the register of delivery by those products he/she has purchased. Customer’s signature means that the Customer has no claims with regard to completeness of the delivery and the quantity and appearance of the products delivered.
6.3.No claims with regard to completeness of the delivery and the quantity and appearance of the products will be accepted upon acceptance of the products by the Customer.
7.Term of the Offer
7.1.This Offer comes into effect at the moment it is accepted by the Customer and will remain in effect until the moment at which the Customer revokes his/her acceptance of the public Offer.
8.Additional Terms and Conditions
8.1.The Website is entitled to assign or to transfer its right and obligations stemming from its relationship with the Customer in any other way to any third party.
8.2.The Website and the services it renders can be temporarily unavailable completely or partially due to preventive or any other maintenance or for any other technical reasons. The Website’s Technical Service is entitled to carry out works on preventive and any other maintenance from time to time either with prior notification of the Customer or without such notification.
8.3.In their relationship the Customer and the Website shall be governed by provisions of the laws of the Russian Federation.
8.4.Should the Customer has any questions or claims, he/she should contact the Website over telephone or in any other way available. The parties shall make any effort to settle disputes which may arise by negotiations. If no agreement is reached, such dispute shall be referred to a competent judicial authority in accordance with current laws of the Russian Federation.
8.5.If a court declares any provision of this Agreement ineffective, other provisions shall remain effective.
